Summary: | The Antarctic Treaty system has developped a liability regime that is mainly based on the recognition of the liability of Antarctic operators for non-compliance with the obligation of response action in cases of environmental emergencies. This regime only covers few cases of responsibility. Moreover, its enforcement within domestic legal orders is quite difficult since it requires to establish specific legal actions for compensation.
