Summary: | Ustav je najvažniji pravni akt neke države kojim država usmjerava svoj razvoj kao i razvoj političkog, gospodarskog i pravnog života unutar svojih granica. Svi zakoni moraju biti usklađeni s ustavom kako bi bili provedivi na legitiman način. Kako bi ta usklađenost bila neupitna biraju se suci koji rade na najvišem i možda najvažnijem položaju neke države, a to je Ustavni sad u Republici Hrvatskoj i Saveznoj Republici Njemačkoj te Vrhovni sud u Sjedinjenim Američkim Državama. Ovaj rad analizirat će modele ustavnog sudovanja u navedene tri države te će se suočiti s problematikom načina odabira sudaca Ustavnoga suda i Vrhovnog suda. Također će biti analizirana i problematika uplitanja politike u sami izbor sudaca Ustavnoga suda u Republici Hrvatskoj i Sveznoj Republici Njemačkoj, odnosno Vrhovnoga suda u Sjedinjenim Američkim Državama. The Constitution is the most important legal document of a country, through which the state directs its development as well as the development of its political, economic, and legal life within its borders. All laws must be in accordance with the Constitution to be enforceable in a legitimate manner. To ensure unquestionable conformity, judges are selected to serve in the highest and perhaps most crucial positi-ons in a country, such as the Constitutional Court in the Republic of Croatia and the Federal Republic of Germany, and the Supreme Court in the United States of America. This paper will analyze the mo-dels of constitutional adjudication in the three countries mentioned above and will discuss the issues related to the methods of selecting judges for the Constitutional Court and the Supreme Court. Additio-nally, it will address the problem of political interference in the appointment of judges for the Constitu-tional Court in the Republic of Croatia and the Federal Republic of Germany, as well as the Supreme Court in the United States of America. |
