Description
Conventional arbitration process still represents a faster, cheaper, simpler and more efficient way of resolving disputes in relation to court proceedings, but no longer reflects these attributes to such an extent as would users of such processes expect. The business subjects are driven by saying »time is money« in their everyday business and due to mentioned the speed and efficiency of resolving commercial disputes are particularly important element in their contractual relations. Due to mentioned needs, faster and cheaper arbitration process, the Chamber of Commerce and Industry of Slovenia adopted a new arbitration rules which came into force on 1st January 2014. The new Ljubljana Arbitration Rules follows the modern international trends in institutional arbitration. Their fundamental guiding principles are:  faster and more efficient procedures,  customer service of high quality,  optimization of time and costs through the possibility of setting up processes which meet their demands (custom process) and  neutral solutions for Slovenian and foreign clients from different cultural and business environments. In this thesis there are presented the main innovations brought by the new Ljubljana Arbitration Rules. Its main focus is on the institution of an Expedited arbitral proceeding, since this is essential in order to achieve the main objective of the new Ljubljana Arbitration Rules, which is to reduce (shorten) the classical arbitration proceeding and thus lowering costs. There is also presented proceeding in front of the Emergency Arbitrator, which is also one of the novelties. According to all available data of The Ljubljana Arbitration Centre at the Chamber of Commerce and Industry of Slovenia it was found out that the number of arbitration procedures have increased and the costs of the procedure has decreased. Both mentioned also due to the new Ljubljana Arbitration Rules. Similar results are expected also in Croatia, where New Zagreb Arbitration Rules were adopted.
