Summary:V diplomskem delu je predstavljena zakonska ureditev sodnega postopka urejanja meje in zajema celovit pregled teorije, s poudarkom in obrazložitvijo na primerih iz sodne prakse. Uvodoma delo opredeljuje tematiko sosedskega prava s kratkim zgodovinskim pregledom urejanja medsosedskih odnosov in predvsem situacije, ko mora konflikt med sosedi reševati sodišče. Poudarek je na enem najbolj tipičnih sosedskopravnih institutov-urejanju meje. Osrednji del diplomske naloge predstavlja sodni postopek ureditve meje, ki ga delimo na nepravdni in pravdni postopek. Za lažje razumevanje sledi primerjava z upravnim postopkom urejanja meje, ki pa ni procesna predpostavka za vložitev predloga za začetek sodnega postopka. Poudarek je na določilih Stvarnopravnega zakonika, ki imenuje tri temeljne kriterije, na podlagi katerih sodišče odloča v mejnih sporih. Ti kriteriji so: močnejša pravica, zadnja mirna posest in pravična ocena in so temelj odločanja v sodni praksi. Nadalje je v diplomskem delu predstavljena vloga izvedenca geodetske stroke, kako le-ta sodeluje s sodnikom na naroku in zunaj njega ter po opravljenem sodnem postopku o sami označitvi meje v zemljiškem katastru. Postopku evidentiranja, sledi krajša predstavitev zemljiškega katastra s poudarkom na definiciji »urejene meje«, ki je kot taka cilj sodnega urejanja meje. Opisan je tudi institut gradnje čez mejo nepremičnine in problematika, ki se v zvezi s tem pojavlja v praksi. Teoretični del se prepleta s praktičnimi primeri iz sodne prakse, kot sekundarnim virom prava, ki konkretizira in razlaga dejanska stanja sodnega urejanja meje. The thesis presents the regulation of the judicial proceeding of boundaries and includes a comprehensive review of the theory, with a focus and an explanation on the cases referred to in case-law. First, the thesis defines the topic of the neighbour disputes law with a brief historical overview of neighbourly relations and, in particular, situations, when a conflict between neighbours must be resolved by the Court. Emphasis is placed on one of the most typical neighbourhood-legal institutions, the regulation of the boundary. The central part of the thesis represents the judicial proceedings regulation of boundary which is divided into non-contentious proceedings and litigation. For ease of comprehension, a comparison with the administrative procedure of regulation of boundaries follows, which is not a procedural requirement for the submission of the proposal to initiate judicial proceedings. The main focus is on the provisions of the Law of Property Code (»Stvarnopravni zakonik«), which identifies three fundamental criteria on the basis of which the Court is to decide on boundary disputes: »stronger right«, »last peaceful possession« and »fair assessment«, thus the decision-making basis in judicial practice. Furthermore, the thesis presents the role of a Land Surveyor Expert, how he interacts with the judge at the hearing and outside the courtroom, and after the completion of the judicial proceedings on the marking of the boundary in the land cadastre itself. The process of registration is followed by a short presentation of the land cadastre with an emphasis on the definition of the »determined boundary«, which is the purpose of the judicial regulation of boundaries. It also outlines the construction over the boundary institute and the cross-boundary issue, which occurs in practice in this regard. The theoretical part is complemented with practical examples from case-law as a secondary source of law, clearly defining and interpreting the actual situation of the judicial regulation of boundaries.
