Summary:Na gradbenem področju prihaja kar pogosto do kršenja gradbene pogodbe. Največkrat se to kaže z zamudo pri izgradnji sami ali pa stvarnimi napakami. Zaplete se pri prevzemanju odgovornosti za nastale napake, kajti vsaka vpletena stranka se otepa odgovornosti glede nastanka napake. Glede na mnoge kršitve pa se zelo malo sporov konča na sodišču. Večinoma se dogovorijo, a v korist močnejše stranke, kajti same tožbe so drage in dolgotrajne. V diplomski nalogi sem najprej predstavil, kaj je pogodba in njene bistvene sestavine. Za dobro izvedbo del je bistvenega pomena cena, ki če je prenizka, ima ponavadi za posledico slabo izvedbo samih del, ki so vzrok za spore. V nadaljevanju pa sem opisal organe, ki skrbijo za dobro izvedbo gradnje. V četrtem poglavju sem s pomočjo ankete ugotovil, kateri so glavni dejavniki, ki vplivajo na spore. Če bi se vse stranke v gradbeni pogodbi držale svojih pogodbenih obveznosti, predvsem, da bi izvajalci naredili tisto, kar je bilo dogovorjeno s ponudbeno ceno, bi po moje bilo manj sporov. Ker pa je v ospredju interes posameznika, je to nekoliko težje izvedljivo. Violations of construction contract are quite common in a construction field. The affect of such violations is mostly seen in delays of the construction itself or in clerical errors. Responsibility for errors is mostly denied by any involved party. Though there are many violations, few disputes end in court. Mostly they make a deal, but in a favour of a stronger party, because the actions it selves are expensive and time-consuming. In the diploma, I first introduced what the contract is and its essential elements. The vitual importance for good performance is the price. Low price leads to bad performance which can lead to disputes. In addition, I described body responsibilities, which are attend to good performance of the construction. In the fourth part / in the section four I have observed through surveys, which are the main factors that affect the conflict. If all parties in a construction contract are consistive in following their contract agreements, especially if subcontractors carry out what it was agreed in the offer price, their would have been less conflicts. Implementation of such action is a bit more difficult due to the interests of any involved individual.
