| Summary: | El Nuevo Constitucionalismo Latinoamericano irrumpe en el Derecho desde la lucha social y la exigencia del reconocimiento de otredades históricamente ignoradas. A través del uso contrahegemónico de algunas constituciones de Latinoamérica, se incorporan conceptos y derechos (subjetivos y objetivos) que incorporan un apartado más al sumario de las garantías de los derechos humanos. El principio de universalidad de los derechos humanos nunca había cobrado tanto sentido, y encuentra en estos constitucionalismos contrahegemónicos el fundamento último que conecta a los derechos humanos (de origen eurocéntrico y occidental) con el buen vivir o "Sumak kawsay" de algunos pueblos indígenas; y esta conexión hace que encontremos en El Nuevo Constitucionalismo Latinoamericano herramientas jurídicas que ofrecen un pensamiento alternativo de alternativas frente a problemas modernos para los cuales no se encuentran soluciones modernas. The New Latin American Constitutionalism arises in Law from the social struggle and the demand for the recognition of historically ignored otherness. Through the counter-hegemonic use of some Latin American constitutions, concepts and rights (subjective and objective) are introduced to expand the guarantees of human rights. The principle of universality of rights makes more sense and finds in these counter-hegemonic constitutionalisms the ultimate foundation that connects human rights (of Eurocentric and Western origin) with the good life or Sumak kawsay of some first nations; this connection makes us find in The New Latin American Constitutionalism legal tools that offer an alternative thought of alternatives to modern problems for which modern solutions are not found. 1.
