| Summary: | Opinnäytetyöni käsittelee huumausaineen käyttörikoksista kiinni jääville nuorille järjestettäviä puhuttelu – ja neuvottelutilaisuuksia. Opinnäytetyön toimeksiantajana toimii Syyttäjälaitoksen Pohjois-Suomen syyttäjäalue. Idea opinnäytetyölle syntyi ollessani harjoittelussa Pohjois-Suomen syyttäjäalueella. Vuoden 2019 alusta lähtien nuorelle, joka jää kiinni huumausaineen käyttörikoksesta ensimmäisen kerran, järjestetään puhuttelutilaisuus poliisin toimesta. Nuoren jäädessä toistamiseen kiinni huumausaineiden käytöstä, järjestetään hänelle neuvottelutilaisuus syyttäjän toimesta. Poliisin järjestämän tilaisuuden tähtäimenä on antaa nuorelle esitutkintalain mukainen huomautus, ja syyttäjän järjestämän tilaisuuden tähtäimenä on syyttämättäjättämispäätös. Toimenpiteillä pyritään selkeyttämään nuorelle teon moitittavuus rikosoikeudellisesti. Tilaisuuksilla pyritään myös tukemaan nuorta päihteettömyyteen ja antamaan mahdollisuus sosiaali- ja terveydenhuollon toimenpiteille. Opinnäytetyön tarkoituksena on kerätä kokemuksia ja mielipiteitä puhuttelutilaisuuksiin vuoden 2019 alussa tulleista muutoksista. Opinnäytetyössä on teoriaa huumausainerikoksista ja nuorten asemasta lainsäädännössä. Lisäksi työssä on lainsäädäntöä liittyen nuorille järjestettäviin puhuttelu – ja neuvottelutilaisuuksiin. Opinnäytetyössä on käyty läpi myös Poliisihallituksen ja Valtakunnansyyttäjänviraston antamia ohjeistuksia tilaisuuksista. Työn tutkimusosa on toteutettu haastattelemalla Oulun poliisilaitokselta nuorisorikosryhmän tutkinnanjohtajaa, sekä Pohjois-Suomen syyttäjäalueelta aluesyyttäjää. Lisäksi työhön on kerätty Valtakunnansyyttäjäntoimiston tilastotietoa syyttäjän järjestämistä tilaisuuksista, sekä Poliisihallituksen tilastotietoa poliisin järjestämistä puhuttelutilaisuuksista. Opinnäytetyöllä saavutettiin vuoden ajalta kertyneet kokemukset Oulun poliisilaitoksen järjestämistä puhuttelutilaisuuksista, sekä mahdollisia syitä sille, miksei Pohjois-Suomen syyttäjäalueella Oulussa ole järjestetty yhtään neuvottelutilaisuutta. Suuria johtopäätöksiä vajaan vuoden seurannalla ei pystytä tekemään. Opinnäytetyössä tuli esille seuraavia kehitysehdotuksia. Syyttäjien tulisi kiinnittää entistä tarkemmin huomiota poliisin neuvottelutilaisuuksiin esittämiin nuoriin. Poliisissa puolestaan voitaisiin myös jatkossa ottaa kantaa syyttäjälle nuoren soveltuvuudesta neuvottelutilaisuuteen. Lisäksi uuden toimintatavan ollessa käytössä vasta lyhyen aikaan, olisi molemminpuolinen palautteenanto tärkeää. My thesis deals with briefings and discussions held for young people who have been caught with unlawful use of narcotics. The employer of this thesis is the National Prosecution authority, Prosecution District of Northern Finland. The idea for this thesis was born while I was doing my internship in the Prosecution District of Northern Finland. Since the beginning of 2019 police have held briefings for young people who have been caught with unlawful use of narcotics for the first time. When a young person is caught for the second time for the use of narcotics, they are held a discussion by the prosecutor. The goal of the briefing organized by police is to give the young person a notice according with the Criminal Investigation Act, and the goal of the discussion held by the prosecutor is to waive the decision of prosecution. These actions attempt to clarify to the young person the blameworthiness of their actions under criminal law. They are also meant to support the young person to sobriety and to offer them the chance to use the services of the social and healthcare system. The purpose of the thesis is to collect experiences and opinions on the changes to these briefings that came into use in the beginning of 2019. The thesis includes theory on offences against the Narcotic Substances and the position of young people in the legislation. In addition, this work includes legislation on the police and prosecutors events that are held for young people. This thesis also goes over the instructions on these briefings offered by the National Police Board and Office of the Prosecutor General. The research part has been conducted by interviewing the head investigator of the youth criminal investigation group in the Police Department of Oulu, as well as the District Prosecutor from the Prosecution District of Northern Finland. This thesis also includes statistics from the Office of the Prosecutor General concerning the events organized by the prosecutor, and statistics from the National Police Board regarding the briefings organized by police. The thesis achieved a year’s worth of experiences from the events organized by Oulu police department, as well as reasons for why there were no events organized by the prosecutor in Oulu. No major conclusions can be made from less than a year of observing. The following improvement suggestions came up in the thesis. Prosecutors should pay closer attention to the young people that they propose to events organized by police. Police, on the other hand, could in future forward their stand to the prosecutor on the young person’s suitability to the event. In addition, as the new course of action has only been implemented for a short amount of time, mutual offering of feedback is important.
