Háværar deilur hafa staðið yfir undanfarin ár um fiskveiðistjórnun á Íslandi þar sem ólík sjónarmið hafa tekist harkalega á um hvernig staðið er að útdeilingu aflaheimilda innan íslenskrar landhelgi. Þessi ritgerð beinir sjónum að svokallaðri uppboðsleið við slíka útdeilingu og spyr hvort hún sé réttlátari heldur en núverandi kerfi. Í ritgerðinni er saga íslenskar fiskveiðistjórnunar rakin, útfærslur á uppboðsleið kynntar og yfirlit gefið um ólíkar kenningar um réttlæti. Skrif íslenskra heimspekinga um meint ranglæti kerfisins eru greind ásamt kenningum hagspekinga um réttlæti og annarra fræðimanna um hvað eigi heima á markaði. Í lokaköflum ritgerðarinnar kemur fram að uppboðsleiðin geti samræmst réttlætiskenningu Johns Rawls að uppfylltum ákveðnum skilyrðum. Þau skilyrði eru meðal annars regluverk sem kemur í veg fyrir einokun, aukið aðgengi og nýliðun og sanngjarn aðlögunartími fyrir fyrirtæki sem nú starfa í greininni. En einnig sanngjörn pólitísk stefnumótun varðandi ráðstöfun þeirra auknu tekna ríkissjóðs sem vænta má í nýju kerfi. In recent years there has been a loud feud in Iceland about the fisheries management system, especially in regards to allotment of fishing quotas within Icelandic territorial waters. This thesis focuses on the so-called auction-way in such allotment and asks whether that method is more just than the current system. The thesis starts by tracking the history of the fisheries management, introducing possible implementations of auction and summarizing different theories of justice. The writings of Icelandic philosophers about the alleged injustice of the system are analyzed, along with theories of authors of market-philosophy and theories about what belongs in the market and what does not. In the final chapters of the thesis, it is stated that the auction-way can fulfill the criteria of Johns Rawls’ theory of justice with a couple of preconditions.
