Summary:European norms and institutions have consolidated a regulatory framework for conflict resolution with a mediation directive; however, its national application is heterogeneous. Thus, to unify its use as an effective mechanism and incorporate the culture of mediation, it has been deemed mandatory in a mitigated way. This article addresses the arising tense doctrinal discussion that supports the reflection on effective judicial protection and security and freedom and justice, essential matters of fundamental rights, democracy, and the rule of law. The current dogmatic criteria are addressed, the right to adequate judicial protection as a fundamental right is analyzed, and finally, European jurisprudence on the subject is discussed, especially the solution of Italian law, which is considered exemplary. Para la solución de conflictos, las normas e instituciones europeas han consolidado un marco regulatorio con una directiva de mediación, a pesar de que su aplicación nacional es heterogénea. Así, para unificar su uso como mecanismo eficaz e incorporar la cultura de la mediación, se ha promovido su obligatoriedad mitigada. Este artículo aborda la tensa discusión doctrinal que surge de allí y que enriquece la reflexión sobre la tutela judicial efectiva y la seguridad, la libertad y la justicia, contenidos esenciales de los derechos fundamentales, la democracia y el Estado de derecho. Se abordan los criterios dogmáticos actuales, se analiza el derecho a la tutela judicial efectiva como derecho fundamental y finalmente se aborda la jurisprudencia europea al respecto, en especial la solución del derecho italiano, que se considera ejemplar.
