Summary:Due to the negative impact of man on the environment, at the present stage of development of civilization, most countries of the world pay close attention to the issues of responsibility for illegal extraction (fishing) of aquatic biological resources. In the presented article the question of public danger of ille- gal extraction (catch) of water biological resources is considered and the analysis of responsibility for this crime with concretization of a subject of encroachment, namely catch of the Kamchatka crab and taking into account practice of Kamchat- ka and Sakhalin is carried out.
