La demande d’avis consultatif présentée par la COSIS au Tribunal international du droit de la mer : quels enjeux ?

International audience On December 12, 2022, the Commission of Small Island States on Climate Change and International Law submitted to the International Tribunal for the Law of the Sea a request for an advisory opinion on the specific obligations of States Parties to the United Nations Convention on the Law of the Sea in relation to the adverse effects of climate change (ocean warming, sea-level rise, ocean acidification). The way in which the Tribunal will mobilize and integrate climate instruments and norms will largely determine its interpretation of the nature, scope and extent of the obligations of the Parties to the Convention, in the context of climate change. La Commission des petits États insulaires sur le changement climatique et le droit international a saisi, le 12 décembre 2022, le Tribunal international du droit de la mer d’une demande d’avis consultatif portant sur les obligations particulières des États Parties à la Convention des Nations Unies sur le droit de la mer face aux effets nuisibles qu’ont ou peuvent avoir les changements climatiques (réchauffement des océans, élévation du niveau de la mer, acidification). La manière dont le Tribunal mobilisera et intègrera les instruments et normes climatiques déterminera en grande partie l’interprétation qu’il fera de la nature, de la portée ainsi que de l’étendue des obligations des Parties à la Convention, dans un contexte de changements climatiques.
