全球气候变化、生物入侵、本地污染和非法、不作报告、不受管制渔业捕捞均对南大洋生态系统及海洋生物多样性造成了一系列重大影响。因此，有效保护南极海域这一特殊的海洋主体，已成为当前海洋保护的重要任务。针对南极海洋保护区资源环境保护的法律规制问题，南极条约体系和《联合国海洋法公约》之间存在一定程度上的重叠、局限和冲突。有效协调二者在法律执行和适用范围方面的冲突，不仅有利于开展南极海洋生物资源养护，推进环境管理，而且有助于梳理南极海洋保护区的总体制度，为其合理建设、有效管理及效用评估提供科学依据和法律支撑。 然而，法律体系建设尤为重要。南极条约体系本身仍然存在着不容疏忽的缺陷和不足，具体包括管辖范围重.
