Texte intégral consultable en ligne International audience Animals play an important part in the lives of the indigenous people of the Arctic. The various international instruments regulating hunting, fishing and herding activities have therefore early instituted derogatory regimes for them. Initially granted as a “privilege” by the states, they were perceived in terms of law as soon as they were enshrined in the context of the rights of the indigenous peoples. Above all, they have been founded on rights we can qualify as “vital”, both from an individual (subsistence) point of view and a collective (culture, identity, way of live) one. Difficulties remain despite this grounding. First, the question arises about the identification of the beneficiaries of these derogatory regimes. These regimes should furthermore be conciliated with the preservation of other rights and interests, especially those relating to the growing preoccupation for the wellbeing and the sensibility of animals. L’animal occupe une place importante dans la vie des peuples autochtones de l’Arctique. Les différents instruments internationaux réglementant les activités de chasse, de pêche et d’élevage dans la région ont ainsi institué, de manière assez précoce, des régimes dérogatoires à leur profit. D’abord concédés à titre de « privilèges » par les États, ils ont été appréhendés en termes de droits dès lors qu’ils ont été inscrits dans le contexte du droit des peuples autochtones. Ils y ont surtout été adossés à des droits que l’on peut qualifier d’« existentiels », tant d’un point de vue individuel (subsistance) que collectif (culture, identité et mode de vie). Cet ancrage n’évacue cependant pas toutes les difficultés. Déjà se pose la délicate question de l’identification des bénéficiaires des régimes dérogatoires. Ceux-ci doivent par ailleurs être conciliés avec la préservation d’autres droits et intérêts, notamment liés à la préoccupation croissante pour le bien-être et la sensibilité animale.
