Za primerjavo smo si izbrali državi, ki imata enak pogled na človekove pravice in svoboščine, vendar zelo drugačen pristop do izvajanja kazenskih sankcij, predvsem smrtne kazni. Opisali smo različne načine smrtne kazni, primerjali, kako so kazen izvrševali pred leti in kako to počno dandanes ter, kako je to povezano s stroški, ki jih ima država ob izvršitvi. Znano je dejstvo, da ZDA še vedno dovoljujejo smrtno kazen za najhujša kazniva dejanja, sami smo iskali upravičene argumente za in proti s pomočjo različnih avtorjev. Preučili smo smrtno kazen na ozemlju današnje Republike Slovenije in kako je se Ustava spreminjala skozi zgodovino razvijanja človekovih pravic in temeljnih svoboščin. Človeško življenje je neprecenljivo, ni cene in stvari, ki bi lahko to zamenjala ali nadomestila s čimer koli drugim. Smrtna kazen kot kazen je za nas le način, da je državi dovoljeno vse, kljub temu da si je nasprotujoča ne le z enim, ampak celo več zakoni hkrati. The aim of the thesis is to examine the penal policies in the Republic of Slovenia and in the USA. In order to make a comparison, we chose two countries that have the same view on human rights and freedoms, but a very different approach to the implementation of criminal sanctions, particularly regarding the death penalty. We described different forms of capital punishment, compared how the penalty had been executed years ago and how it is today, and how this relates to the costs incurred by the state at the time of the execution. As is widely known, the USA still allows capital punishment for the most serious crimes. For that reason, our aim was to determine legitimate arguments for and against with the help of several authors. We examined the death penalty on the territory of the present-day Republic of Slovenia and how the Constitution has changed throughout history of the development of human rights and fundamental freedoms. Human life is invaluable and priceless and there is nothing else out there that could ever replace it. The death penalty as a punishment shows us that the country knows no limits although not one but even several contradictory laws are in force at the same time.
