Este trabalho pretende examinar a situação político-jurídica do Ártico, bem como sua relação com o Direito do Mar e o Direito Internacional Ambiental. A conjuntura atual da região suscita questões envolvendo expansão das plataformas continentais, a governança de espaços compartilhados, a cooperação em fóruns internacionais e a utilização de recursos minerais. Porém, a exploração dos recursos naturais ocasiona sério impacto no meio ambiente. Procura-se avaliar a possibilidade de um sistema de tratados específicos para o Ártico. Para alcançar esse objetivo, a pesquisa foi dividida em duas partes: num primeiro momento, será apresentado o regime jurídico dessa região, bem como as várias disputas territoriais existentes; no segundo, será analisada a relação do Ártico com temas de Direito Internacional Público, a saber Direito do Mar e Direito Ambiental, concluindo-se pela necessidade de criação de um novo sistema de tratados para o Ártico que seja vinculante (hard law), baseado no modelo da Antártica, mas com características próprias. Por fim, o método utilizado foi o hipotético-dedutvo, incluindo abordagem histórica e pesquisa bibliográfica. This work aims at examining Arctic’s political and legal situation, as well as its connection with Law of the Sea and International Environmental Law. Due to the present conjuncture, issues arise concerning the expansion of continental shelves, the governance of shared spaces, the cooperation in international forums and the utilization of mineral resources. However, the exploration of natural resources causes serious impact on the environment. The intention is to study the possibility of a system of treaties specific to the Arctic.
