The aim of the study, is to examine how the problem with acceding to the ILO Convention 169, is represented by the commissioner in SOU 1999:25. In addition, we seek to highlight how the social status of the Sami in Sweden, is affected by the discourse that the official report is part of. The analysis is based on a postcolonial perspective. The method used is a form of discourse analysis, called "What's the problem?", in which a number of questions are put to the material. The results show that in the SOU 1999:25, the main problem and impediment to ratify the ILO Convention 169, is formulated to be a question of Sami rights to their land. Our conclusion is that this way of presenting the problem, is based on a reproduction of colonial conceptions. Therefore colonialism in Sápmi can not be considered history just yet.
