All societies know the binary classification of gender which consists in classifying the individuals as man or woman, with the exception of certain societies which recognize the existence of a third gender. The predicament of intersex people raises the question of the domination of social values inherent in gender binaries. The belief in a unique and fixed gender identity is pervasive among most psychologists, psychiatrists, medical doctors, judges in France. French medical establishment interfere with bodily integrity and genitalia of intersex people while depriving them of their choice of gender identity. Many societies have problems conceptualizing the notion of indeterminacy or fluidity in gender identity. All the recent legal evolutions in this domain are due to collective mobilizations of intersexual and trans people, fighting to question the domination of gender bipolarization. Aucune société n’échappe à la classification binaire des identités sexuées qui consiste à classer les individus entre homme et femme, à l’exception de certaines sociétés qui reconnaissent l’existence d’un « troisième genre ». L’analyse de la situation des personnes intersexuées en France met au jour la domination sur le plan des valeurs sociales de cette bicatégorisation. La croyance en une identité sexuée unique et fixe est prégnante dans la société comme chez la plupart des psychologues, des psychiatres, des médecins, et des juges, les notions de « troisième genre » ou d’indétermination de l’identité sexuée restant largement incomprises. Toutes les évolutions sociales et légales dans ces domaines survenues dans d’autres pays que la France sont dues à la mobilisation de personnes intersexes et trans qui mettent en cause le binarisme des identités sexuées.
