François Luchaire enumerates the collection of entities which make up French overseas territories (i.e. overseas departments and regions as defined by Article 73 of the Constitution, “other communities” as defined by Article 74, the situation of New Caledonia, the situation of the South Pole and Antarctic territories, the Ile of Clipperton) and examines case by case the modality of how each belongs to the Republic. This adherence implies the respect of principles upheld by the Constitution which are inseparable form the Republic such as indivisibility, separation of church and state, equality, sovereignty, the democratic nature of the Republic, its decentralized character and its social aspects. Both state bodies and the communities of the overseas territories are defined by its limitations. Nevertheless, beginning from when the 1958 Constitution proclaimed in its preamble the principle of self determination, the question has arisen to know under what conditions this principle allows an overseas community to leave the Republic. One by one, the author examines the hypothesis of cessation and then that of secession. L’article fait un état des lieux du statut constitutionnel de la France d’outre-mer. François Luchaire passe ainsi en revue l’ensemble des entités formant l’outre-mer (les départements et régions d’outre-mer régis par l’article 73 de la Constitution, les « autres collectivités » régies par l’article 74, la situation de la Nouvelle-Calédonie, la situation des terres australes et antarctiques, l’Ile de Clipperton) et examine dans chaque cas son mode d’appartenance à la République. Celle-ci implique le respect des principes dont la Constitution affirme qu’ils sont inséparables de la République (l’indivisibilité, la laïcité, l’égalité, la souveraineté, le caractère démocratique de la République, son caractère décentralisé, ses aspects sociaux).
