L’océan Arctique et la coopération intergouvernementale non contraignante : Un défi pour la protection internationale de l’environnement

The Conference of the Parties to United Nations Framework Convention on Climate Change which took place in Copenhagen in December 2009 illustrates the difficulties met by international preservation of the environment. Coercive legal framing of polluting activities at international level often clashes with strategic and economic interests of States concerned. The Arctic Ocean, an extremely fragile ecosystem coveted by States owing to its resources in hydrocarbons and its waterways is a very good example of the problem. The present article means to approach informal regional and non coercive cooperation as a coherent step towards the creation of mandatory and stable legal systems. Without renouncing a global framework, the reinforcement of the role of regional initiatives, e.g. the Arctic Council, is a means of conciliating the need of an efficient protection of the environment with issues of political practicability due to the reluctance of States to commit themselves.`np pagenum="628"/b La conférence des parties de la Convention-cadre des Nations Unies sur le changement climatique, qui a eu lieu à Copenhague en décembre 2009, a illustré les difficultés auxquelles la protection internationale de l’environnement se trouve confrontée. Un encadrement juridique contraignant des activités polluantes au plan international se heurte souvent aux intérêts stratégiques et économiques des Etats concernés. L’océan Arctique, un écosystème extrêmement fragile et convoité par les Etats côtiers en raison de ses ressources d’hydrocarbures et voies navigables, est un excellent exemple de cette problématique. La présente contribution propose d’appréhender la coopération informelle, régionale et non contraignante comme une étape cohérente vers la création de régimes juridiques de protection contraignants et durables.
