LE DROIT AU LOGEMENT TEL QUE VU PAR LE PACTE INTERNATIONAL RELATIF AUX DROITS ÉCONOMIQUES, SOCIAUX ET CULTURELS : SA MISE EN OEUVRE QUÉBÉCOISE EST-ELLE CONFORME ?

At the heart of the debate over the justiciability of economic, social and cultural rights, this article offers a deep analysis of the right to housing as seen by the ICESCR. It aims to study the compliance of the Quebec case regarding the latter and with respect to other standards drawn from international law. In addition to the domestic legal framework, both federal and provincial policies and budgets promoting housing rights for Quebecers with low income are also scrutinized. Public housing and housing subsidies receive a great deal of attention, where some marginalized groups, requiring special types of accommodation or being in a precarious position in terms of housing, are highlighted: homeless people, women fleeing violence, First Nations and people with disabilities. To conclude, we will try to present a few thoughts and possible solutions to improve the noticeably deficient situation according to our reading of the obligations under the ICESCR. Au coeur du débat entourant la justiciabilité des droits économiques, sociaux et culturels, cet article analyse en profondeur le droit au logement tel que vu par le Pacte international relatif aux droits économiques, sociaux et culturels. Il propose une étude de la conformité du cas québécois par rapport à ce dernier ainsi qu’au regard des autres normes tirées du droit international. Outre le cadre législatif interne, les politiques et les budgets, tant fédéraux que provinciaux, favorisant le droit au logement pour les citoyens québécois plus démunis sont également scrutés. Le logement social et subventionné reçoit une grande attention de notre part, où certains groupes marginalisés qui ont pour dénominateur commun le fait d’avoir des besoins spécifiques ou de vivre une situation difficile au niveau de l’habitation, sont mis de l’avant : itinérants, femmes victimes de violence, Premières Nations, personnes handicapées. En conclusion, nous tenterons de lancer quelques pistes de réflexion voire de solution afin d’améliorer la situation, visiblement ...
