Summary: | Is the mingling of Aboriginal governance and identity pluralism in Nunavut nothing more than a pious hope : Shall the twain ever meet ? The theoretical framework of liberal constitutionalism has actually defined them in a way that alternatively renders their conciliation impossible or contradictory. It is then of the uttermost importance, and even an ethical obligation, to rethink the framing of this question. The particular history of Nunavut, intertwined with certain special legal identity strategies, has prompted me to talk about Nunavut as a genuine model of modern Aboriginal governance. In a situation of legal pluralism, dialogical pluralism quickly becomes the primary institutional condition for the good working of this hybrid governance model, whose ultimate goal remains the protection of a renewed identity pluralism. Comment se concilient gouvernance autochtone et pluralisme identitaire dans le cas particulier du Nunavut ? Ces deux termes ont été forgés dans le cadre théorique du constitutionnalisme libéral, qui rend la conciliation soit impossible, soit contradictoire une exigence éthique conduit à repenser les termes de la question. L’histoire particulière du Nunavut, ainsi que les stratégies contentieuses identitaires, m’ont permis de le qualifier de modèle de gouvernance autochtone moderne. S’appuyant sur une forme de pluralisme juridique, rapidement le pluralisme dialogique est devenu la condition à cette gouvernance hybride au Nunavut, dont la finalité évidente est la garantie d’un pluralisme identitaire renouvelé. |
