Ritrýnd grein Með „langri“ 20. öld er hér átt við tímabilið frá því grunnur var lagður að núverandi sambandi ríkis og kirkju með stjórnarskránni 1874 þar til stjórnlagaráð lagði fram tillögu að breytingu í þessu efni árið 2011. Fengist verður við uppruna og þróun 62. gr. stjskr. en rætur hennar er að finna í dönsku stjórnarskránni frá 1849. Gerð verður grein fyrir breytingum sem orðið hafa á ákvæðinu, þá verður ákvæðið túlkað í ljósi dansks og íslensks stjórnskipunarréttar. M.a. verðu leitast við að skýra hvort ákvæðinu sé ætlað að vera lýsandi eða trúarpólitískt normerandi. Dregið verður fram hvaða skyldur ákvæðið leggur á þjóðkirkjuna og hvaða kvaðir það leggur á ríkið. Ennfremur verður fjallað um hvort og þá hvernig þjóðkirkjuskipan samræmist trúfrelsi og fjölmenningu, sem og hvaða breytingar æskilegt sé að gera á núgildandi kirkjuskipan í ljósi breyttra samfélagsaðstæðna frá því á 19. öld. Lykilorð: Samband ríkis og kirkju, nútímavæðing The term “long” 20th century refers to the period since the foundation was laid for the current relationship of church and state in Iceland with the Constitution of 1874 until the Constitutional Council in 2011 submitted a bill for its amendment. The objective is to take a look at the origin and the development of article 62 of the Icelandic Constitution which has its roots in the Danish Constitution of 1849. The analysis gives an account of the changes that have been made to the article and its interpretation in respect to the Danish constitutional right. Including an attempt to clarify whether the article is intended to be descriptive or religious politically stipulating. What duties the article imposes on the national church and what obligations it places on the government. Furthermore, it will discuss whether and how the church order is compatible with the religious freedom and multiculturalism, as well as what changes to the existing church order are desirable in regards to the social changes that have occurred since the 19th century.
