A description is provided of the current characteristics of the legislation on smoking at the workplace in the fifteen European Union (EU) Member States., as well as in other European countries such as Hungary, Iceland, Norway, Poland, Rumania and Switzerland. A review is also provided of the court cases which have taken place based upon this legislation with regard to smoking at the workplace in these countries. Legislation is a crucial part of any strategy for controlling smoking. Without legislation, no action against exposure to tobacco smoke-polluted air will be effective. However, a law does not suffice in itself and will solely be effective if supported by public opinion.
