The Limits of the National Territory: Review of the Delimitation Instruments

As a result of spatial analysis about th e present boundaries of chilean state's territory, the authors are looking on the political attitude which made the fragmented land with "pieces" in South America, Antarctic, Polinesia and maritime territory . From the begining, the chilean attitude was regulated by "uti possidetis iure" of 1810; but the differentes political transaction with neighbors states and the international community gave a different ext ention and form. As the analysis show, the actual estention and form of the chilean state territory it is the result of the relation of power and political idea of doing it. The way to do was het erogeneus, because the political organization was acting casuistica/y in re/ation to various difficulties. Observando y analizando el conjunto de instrumentos jurídicos, nacionales e internacionales, los autores sistematizan los límites actuales del territorio estatal chileno. La diversidad de negociaciones, inicialmente gobernadas por la noción del ''uti possideti s de 1810", llevó a la conformación de un Estado de territor ios fragmentados (Sudamérica, Antártica, Polinesia y territorio maritimo) el cual puede caracterizarse como un "país marítimo y tricontinental ". El análisis espacial o geográfico de cada uno de los instrumentos jurídico-político permite establecer que la forma y extensión del territorio estatal chileno no responde a un icono ideológico o doctrinario. Simplemente es el resultado del accionar político por las relaciones de poseer y de la voluntad política de hacerlo. Además está vinculado a un quehacer político territorial casuístico y a una conducta político-territorial heterogénea.
