Summary:Childhood in the Constitution of the Republic of Lithuania is entrenched as a particularly protected value. When parents improperly implement their duties towards children and violate the rights of the minor child protected by legal acts, the state must protect minor children and immediately ensure the safety of their best interests. One of the most drastic ways of securing a child's best interests is to take the child from the family. Undergraduate work includes analysis of both national and international legal documents, analysis of case law, and scientific literature analysis to reveal the legal aspects of the protection of the child’s rights, focusing on taking the child from his or her representatives in accordance with the law. Work investigates the concept of the child as a legal entity, legal documents regulating the field of the child’s rights and the protection of the child’s rights in Lithuania, the institutions ensuring the protection of the rights of the child, the concepts, causes and bases of taking the child from his/her representatives in accordance with the law, the organization of the taking of the child from family institutions and the legal documents regulating their liability, the protection of the child’s rights in Iceland and the documents regulating the system of the protection of the child’s rights. Analysis in the final work is developed on both a theoretical and a practical level. The main focus was on identifying the problem related to the regulation and application of the child's representatives in accordance with the law in practice and to make proposals for improving the regulation and practical application
