Along this line, this article presents an analysis of the artistic work “Bamba, martillo y refilón” of Fabio Melecio Palacios, using various analytical frameworks to understand and explain the violence exercised by the law that are represented in this artistic work. Thus, this article presents the experiences of the cane cutters represented in Palacios’s artistic work, linkingthem with the ineffectiveness and inoperability of labor regulations, with an analysis of the operation of the law in the hegemonic constitution of the sugar mills in Valle del Cauca and its operation under a colonial mode. For this purpose, the text is based on interviews with Fabio Melecio Palacios, visits to the arctic work “Bamba, martillo y refilón”, literature review and processing of some quantitative data that support the law violence representations found in Palacios's work. El estudio del arte como manifestación de las instituciones sociales no escapa de la órbita del derecho y la teoría jurídica, existiendo varias aproximaciones de los efectos y vivencias de las normas jurídicas por parte de los individuos que se plasman en obras o performance artísticos. Bajo esa línea, este artículo presenta un análisis de la obra “Bamba, martillo y refilón” del artista Fabio Melecio Palacios en el que se usan diversos marcos analíticos para comprender y explicar las violencias ejercidas por el derecho que se encuentran representadas en la obra. De este modo, el texto presenta las vivencias de los corteros de caña representadas en la obra de Palacios ligándolas con la ineficacia e inoperatividad de las normas laborales, junto con un análisis de la operatividad del derecho en la constitución hegemónica de los ingenios azucareros del Valle del Cauca y su operatividad bajo una lógica colonial. ...
