Bu makalenin konusunu, çevre göstericilerinin yapmış oldukları eylemler sırasında Devletler tarafından girişilmiş fiillerin hukuksal planda analizi ve bu bağlamda, bireylerin uluslararası hukuk alanında sahip olduğu temel haklar oluşturmaktadır. Denizin korunması söz konusu olduğunda, Devletler her zaman çevre koruma aktörü rolünü oynamazlar. Yetkililer eylemcilere karşı, zaman zaman keyfilik içeren, hatta illegal nitelikte müdahalelerde bulunmaktadırlar. Makalede bu yön « Arctic Sunrise» et “Rainbow Warrior” davaları ışığında incelenmektedir. Olayların ve davaların başlıca aşamaları özetlendikten sonra, çalışma, özellikle deniz hukuku tarafından da korunan birey hakları üzerinde durur: kişi özgürlüğü hakkı ve toplanma özgürlüğü. “Kamu düzeni” ve “kısıtlamalar” kavramlarına yer veren makalede, bu kavramların, “uluslararası kamu düzeni” ve “uluslararası topluluk” kavramları ışığında yorumlanması gerektiği vurgulanmaktadır The subject matter of this Article is the legal analysis of the acts of States during environmental demonstrations of activists and in this framework, the individual’s rights under International Law. When the issue is the protection of the waters, the States do not always play the role of protector of the environment. The officials always tend to show arbitrary and yet illegal interference towards the protestors. This issue is examined in this Article in light of the “Arctic Sunrise” and “Rainbow Warrior” Cases. After a brief summary of the main phases of these Cases, this Article especially emphasizes the individual’s rights such as the right of freedom and security and the right of freedom of assembly with respect to the Law of the Sea. In this Article, the concepts of “public order” and “restrictions” are discussed and it is emphasized that these concepts should be interpreted in light of two other concepts which are “international order” and “international community”
