The various international instruments regulating hunting, fishing and herding activities have therefore early instituted derogatory regimes for them. Initially granted as a “privilege” by the states, they were perceived in terms of law as soon as they were enshrined in the context of the rights of the indigenous peoples. Above all, they have been founded on rights we can qualify as “vital”, both from an individual (subsistence) point of view and a collective (culture, identity, way of live) one. Difficulties remain despite this grounding. First, the question arises about the identification of the beneficiaries of these derogatory regimes. These regimes should furthermore be conciliated with the preservation of other rights and interests, especially those relating to the growing preoccupation for the wellbeing and the sensibility of animals.
