Landis, Deputy County Attorney, Yavapai County Attorney's Office, Prescott, concurring with the first two points given in an opinion by the deputy attorney to the Beaver Creek School District concluding that a gift of real property or personal property could be used to construct a building addition only by the vote of the electorate pursuant to Ariz. Rev. Stat. § 15-442 (A). assuming that such gifts did not contradict constitutional authority and that a school district did not have the authority to accept a gift of cash without the requirement of the election. The opinion disagreed with the deputy attorney's opinion about the designation of funds from the cash gifts.
